Welcome to Tailored Blinds Inc. ("we", "our", "us"). By accessing or using our website, www.tailoredblinds.ca (the "Site"), or engaging with our services, including the design, sale, and installation of custom window and door coverings (the "Services"), you agree to be bound by the following Terms of Service (the "Agreement"). Please read these Terms carefully before using our Site or Services. If you do not agree with these Terms, you should not use our Site or Services.

1. Acceptance of Terms

By using the Site or Services, you agree to comply with and be bound by these Terms of Service, which may be updated or modified by us at any time. We will provide notice of any changes by updating the "Updated" date at the top of this page. Continued use of the Site or Services following such changes constitutes acceptance of the updated Terms.

2. Services Provided

Tailored Blinds Inc. offers custom-designed window and door coverings, which include blinds, shades, shutters, drapes, and related products. We also provide installation services for the products we sell. The products and services offered through our website and business are subject to availability and may be modified or discontinued at our discretion.

3. Eligibility

By using our Site or Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using our Site or Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration

To access certain features of the Site or request services, you may need to create an account. When you create an account, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

If you suspect any unauthorized use of your account, you agree to notify us immediately at info@tailoredblinds.ca.

5. Products and Orders

  • Product Availability: All products and services offered on our Site are subject to availability. We reserve the right to limit quantities or refuse orders for any reason.

  • Pricing: Prices for products and services are listed in Canadian dollars (CAD) and may change at any time without notice. Prices are exclusive of taxes, shipping, or installation fees unless otherwise indicated.

  • Order Confirmation: When you place an order, we will send you an order confirmation via email. This does not constitute an acceptance of your order. We reserve the right to refuse or cancel any order at our discretion.

6. Payment

  • Payment Methods: We accept various payment methods, including credit cards, debit cards, and other methods available on our website, as well as cash, cheque, or money-order at the time of purchase.

  • Billing: By submitting an order, you authorize us to charge your payment method for the total amount of your order, including applicable taxes, shipping, and installation fees. If your payment method is declined, we may cancel your order.

7. Installation Services

We provide professional installation services for the products you purchase from us. You agree to cooperate with our installation team and provide them with access to the necessary areas to complete the installation. The installation fee will be determined based on the scope and complexity of the project.

If you need to reschedule or cancel an installation, please contact us at least 48 hours in advance. Failure to do so may result in additional fees.

8. Returns and Refunds

Most of our products are covered by our Limited Lifetime Warranty. Please see WARRANTY or visit www.tailoredblinds.ca/warranty for more information.

  • Product Returns: Considering that our products are custom made for each client, we do not accept returns, exchanges, or refunds. However, for products that were installed defective or damaged by us or our manufacturer, we will repair or replace your product based on our investigation. If you receive a product that you believe is damaged or defective, please contact us by email at info@tailoredblinds.ca within 7 days of receiving the product, and we will work with you to resolve the issue.

  • Refund Process: Refunds, if applicable, will be issued to the original payment method and processed within a reasonable time after the return is approved.

9. Intellectual Property

All content on the Site, including text, images, graphics, logos, and software, is the property of Tailored Blinds Inc. or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, distribute, or display any of the content without our express written permission.

10. User Conduct

When using the Site or Services, you agree not to:

  • Violate any applicable laws or regulations.

  • Engage in any activity that could harm the functionality or security of the Site or interfere with other users' experience.

  • Submit false, misleading, or offensive content.

  • Attempt to access or modify any part of the Site or our systems without authorization.

We reserve the right to suspend or terminate your account or access to the Site if you violate these Terms.

11. Limitation of Liability

To the fullest extent permitted by law, Tailored Blinds Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services, including, but not limited to, loss of profits, data, or use. Our liability for any direct damages will be limited to the total amount paid by you for the specific products or services related to the claim.

12. Indemnification

You agree to indemnify and hold harmless Tailored Blinds Inc., its officers, directors, employees, and agents, from any claims, damages, liabilities, costs, and expenses arising from your use of the Site, violation of these Terms, or infringement of any rights of a third party.

13. Force Majeure

We will not be liable for any failure to perform our obligations under this Agreement if such failure is due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, labor disputes, or technical failures.

14. Governing Law

These Terms will be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Toronto, Ontario.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Tailored Blinds Inc. regarding your use of the Site and Services. Any previous agreements, whether oral or written, are superseded by these Terms.
